Job Overview:
We are seeking an experienced Legal Manager with expertise in Real Estate Regulatory Authority (RERA) compliance to join our legal team. This position is responsible for ensuring that the organization adheres to all applicable RERA regulations, handles legal aspects of real estate projects, and manages legal risks in the real estate domain. The ideal candidate will have a deep understanding of RERA laws, regulations, and guidelines, along with strong legal drafting and communication skills.
Key Responsibilities:
- RERA Compliance Management:
- Ensure company adherence to RERA regulations and guidelines across real estate projects.
- Monitor and analyze changes in RERA laws, rules, and regulations and ensure timely updates to company policies and practices.
- Prepare and submit RERA registrations, applications, and filings for real estate projects as per regulatory requirements.
- Handle the preparation of RERA-compliant agreements, such as sale agreements, construction agreements, and allotment letters.
- Advise internal teams on RERA-related matters including disclosures, penalties, and dispute resolutions.
- Contract Drafting & Negotiations:
- Draft and review contracts related to real estate transactions, including sale deeds, project development agreements, joint ventures, and other contractual arrangements in accordance with RERA.
- Ensure all contracts are compliant with RERA provisions, and safeguard the organizations legal interests.
- Risk Mitigation & Legal Advisory:
- Provide legal advice to senior management and project teams on RERA matters, ensuring the organizations risk is minimized.
- Review and manage any legal disputes related to RERA compliance, including disputes with customers, contractors, or regulatory authorities.
- Coordinate with external legal counsel when necessary to resolve complex RERA-related issues.
- Litigation & Dispute Resolution:
- Represent the company in RERA-related disputes before the regulatory authority, consumer forums, or any other relevant authorities.
- Assist in the preparation of legal documents and case management for disputes involving RERA non-compliance or other related issues.
- Compliance Audits & Reporting:
- Conduct regular audits of ongoing and completed projects to ensure compliance with RERA.
- Prepare and submit regular compliance reports to the management and external regulatory bodies.
- Maintain proper documentation of all RERA-related filings, approvals, and communication.
- Training & Development:
- Train internal teams (including project managers, marketing, and sales teams) on RERA compliance requirements and best practices.
- Stay updated with industry trends and legal developments related to RERA, real estate laws, and consumer protection.
Required Qualifications & Skills:
- Education: LLB (Bachelor of Laws) or equivalent. Additional certifications in real estate law, RERA compliance, or similar fields are preferred.
- Experience:
- Minimum of 5-7 years of experience in legal roles, with a focus on real estate law and RERA compliance.
- Strong knowledge of the RERA Act, rules, and regulations, as well as general real estate laws and regulations.
- Skills:
- Strong legal research and analytical skills.
- Excellent written and verbal communication.
- Detail-oriented with a strong focus on compliance and risk management.
- Ability to manage multiple tasks and deadlines in a fast-paced environment.
- Proficiency in MS Office (Word, Excel, PowerPoint) and legal software tools.
Preferred Qualifications:
- Experience working with real estate developers, construction companies, or in-house legal teams.
- Familiarity with real estate financing, joint ventures, and land acquisition laws.
- Prior experience in litigation or arbitration related to RERA compliance.
